Barrington Illinois Foreclosures - How does a property get foreclosed on? Illinois is a judicial state which means all foreclosures have to go through the courts. If a borrower misses 3 monthly payments a Notice of Default - NOD - is issued. This is notice to the borrower that now they are 90 days behind the bank is intending to start foreclosure proceedings. After another 30 days a Summons is issued to the borrower with a court date and time. A borrower is not required to attend but can to plead their case. The judge will rule in favor of lender or borrower. If ruled in favor of the lender - bank - it typically takes another 7 months or so for the foreclosure to take place. Nearer this time the bank will attempt to sell the property at the Sheriffs sale. A notice will be sent to the borrower - NFS. If no sale takes place then the bank will take possession of the property and a Deed will transfer ownership to them. The borrower is required to leave the house hopefully voluntarily but if not then forcefully. the bank will now list the home for sale as a foreclosure but this can take another 6 months. Some are faster than others. During this entire 10 month or more period the borrower can cure the default by bringing the account up to date including all charges. There are plenty of public sites available that have all of this information but usually you have to pay - and the information is not always up to date. You'll find homes on them that sold months ago or were cured. Local newspapers also publish the information but it is slow to appear. Consider the following before you decide. - Are you looking for a run down property to fix and flip or gain instant equity? Foreclosures are a good option.
- Are you looking to buy at 50c on the dollar? Foreclosures will not work as the banks know what the homes are worth and will not sell to low ball offers. This is the biggest mistake buyers make!
- Are you looking for a family home but are very flexible on what you need? Foreclosures might work for you but with a low inventory you may have to wait.
- Are you looking for a family home and have the standard shopping list of wants? Unlikely you'll find a foreclosure because there will not be enough inventory for you to choose from.
- Do you have a home to sell before you can buy? Forget foreclosures - sale contingencies in general are not considered by banks.
As you can see it depends on your goals but consider this as well. Often times you can get a better deal on the open buyers market. If you buy a foreclosure and have to spend money to fix problems or update the home, you might spend more. Everyone is different and I would gladly sit down and talk with you about your goals and come up with a plan of action. One last thing - many foreclosures sell in 2 weeks or less, so be prepared to jump and make a quick decision or you will loose the property.
